1. Acceptance of Terms: By utilizing the services provided by Royal Heritage Transport Services, LLC ("Royal Heritage," "we," "us," or "our"), you ("Customer," "Shipper," or "you") agree to be bound by these Terms and Conditions. These Terms and Conditions constitute a legally binding agreement between you and Royal Heritage. If you do not agree with any part of these Terms and Conditions, you must not use our services.
2. Services Provided: Royal Heritage provides courier pickup and delivery services, including but not limited to:
● Same-day delivery
● Scheduled delivery
● Package and document delivery
● Specialized delivery (as agreed upon) Specific service details, including delivery times and locations, will be agreed upon and documented in individual service agreements or order confirmations.
3. Customer Responsibilities:
● Accurate Information: You are responsible for providing precise and complete information, including sender and recipient details, delivery addresses, and package descriptions.
● Packaging: You are responsible for properly packaging items to ensure safe transport. Royal Heritage is not liable for damage resulting from inadequate packaging.
● Prohibited Items: You agree not to ship prohibited items, including but not limited to:
- Hazardous materials (as defined by applicable regulations)
- Illegal substances
- Firearms and ammunition (unless explicitly agreed upon and in compliance with all applicable laws)
- Perishable goods (unless specifically arranged)
- Currency, negotiable instruments, and precious metals (unless specifically arranged and insured)
● Availability: You are responsible for ensuring that the sender and recipient are available at the designated pickup and delivery locations at the agreed-upon times.
● Payment: You are responsible for paying all applicable fees and charges as agreed upon.
4. Royal Heritage Responsibilities:
● Delivery: Royal Heritage will make reasonable efforts to deliver packages according to the agreed-upon schedule.
● Care: Royal Heritage will exercise reasonable care in handling and transporting packages.
● Communication: Royal Heritage will provide reasonable communication regarding the status of deliveries.
5. Limitation of Liability:
● Royal Heritage's liability for any loss or damage to a package is limited to the lesser of the declared value of the package or a maximum amount as specified in our rate schedule, unless a higher value is declared, and insurance is purchased.
● Royal Heritage is not liable for indirect, incidental, consequential, or punitive damages.
● Royal Heritage is not liable for delays or failures in delivery caused by events beyond our reasonable control, including but not limited to:
- Acts of God
- Traffic delays
- Weather conditions
- Strikes or labor disputes
- Incorrect address provided by the customer.
● Royal Heritage is not liable for damages caused by improper packaging.
6. Insurance:
● Basic liability coverage may be included in our standard rates.
● Additional insurance coverage may be purchased for higher-value items.
● Claims for loss or damage must be filed within a specified timeframe (7 days) of the delivery date.
7. Payment Terms:
● Payment is due upon receipt of the invoice or as otherwise agreed upon.
● Royal Heritage reserves the right to withhold delivery until payment is received.
● Late payments may be subject to interest charges.
8. Changes to Terms and Conditions:
● Royal Heritage reserves the right to modify these Terms and Conditions at any time.
● Changes will be effective upon posting them on our website or by notification to customers.
● Continued use of our services constitutes acceptance of the modified Terms and Conditions.
9. Governing Law:
● These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law principles.
10. Dispute Resolution:
● Any disputes arising from these Terms and Conditions shall be resolved through Mediation, Arbitration, or Court Jurisdiction in Jackson, Mississippi.
11. Severability:
● If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12. Entire Agreement:
● These Terms and Conditions constitute the entire agreement between you and Royal Heritage and supersede all prior agreements or understandings, whether written or oral.
